This website, www.maikupo.com (hereinafter, the "Website"), is owned by ARTECO CONSULTING, S.L., with Tax Identification Number (NIF) B57734600, registered in the Mercantile Registry of the Balearic Islands (Sheet PM-68562, Volume 2479, Page 153, Entry 2). TERMS AND CONDITIONS OF USE

Purpose of the Conditions: the Website

These Terms and Conditions of Use (the "Terms") regulate access to and use of the Website, including the external appearance of its interfaces, the navigation tree, the contents integrated into them (the "Contents"), and the online services or resources offered to users (the "Services").


MaiKupo may modify, at any time and without prior notice, the presentation and configuration of the Website, as well as the Contents and Services. The User acknowledges and accepts that MaiKupo may interrupt, deactivate, and/or cancel any of the elements integrated into the Website.


Access to the Website is, as a general rule, free of charge for Users, without prejudice to the connection costs through the telecommunications network contracted by the User.


Some Contents or Services may require prior subscription or registration by the User.

The User

Access, browsing, and use of the Website, as well as participation in any interactive spaces, confer the status of user (the "User"). From the moment browsing begins, the User accepts these Terms and any subsequent amendments, without prejudice to the application of mandatory legal provisions. Users are encouraged to review these Terms each time they visit the Website.


The User undertakes to use the information, Contents, and/or Services offered by MaiKupo in accordance with the law, these Terms, morality, public order, and the rights of third parties, and not to perform any actions that may damage the proper functioning of the Website.


The User is responsible for the accuracy and legality of the information provided in any forms that MaiKupo may require to access specific Contents or Services, and must immediately notify MaiKupo of any event that may lead to misuse of such information (including, without limitation, theft, loss, or unauthorized access to identifiers or passwords) so that they may be cancelled promptly.


MaiKupo reserves the right to remove comments or contributions that violate the law, are discriminatory, xenophobic, racist, pornographic, constitute spam, harm minors, or are otherwise inappropriate.


MaiKupo is not responsible for opinions expressed by Users through participation tools. Accessing the Website does not establish any commercial relationship between MaiKupo and the User.


The User declares to be of legal age and to have sufficient legal capacity to be bound by these Terms. This Website is not directed at minors.

NATURE OF THE SERVICE: MARKETPLACE FOR TIME-BASED SESSIONS

MaiKupo is a platform that enables providers of experiences and activities (the "Providers") to publish and manage time-based sessions over general resources with controlled capacity (for example, language classes, sports court bookings, workshops, guided tours), and allows end users ("Customers") to discover and book these sessions.


Unless expressly indicated otherwise, MaiKupo acts as an intermediary that provides the technological platform and booking management tools. The contract for the provision of the session is formed directly between the Customer and the Provider. Each Provider is solely responsible for its sessions, resources, staff, compliance with applicable law, safety, and customer service.


Capacity (quota) control, schedules, pricing, and availability are configured by each Provider within the platform. MaiKupo may provide default settings or templates, but the final conditions for each session are established by the Provider.

FEES, COMMISSIONS, AND PAYMENTS

MaiKupo monetizes the Service by charging the Provider a management commission for each booking. The commission consists of a percentage applied to the booking price and a minimum fixed amount, as configured in the Provider's settings. Taxes may apply according to the applicable law.


Payments are processed by Stripe. Funds flow from the Customer to the Provider, and MaiKupo's commission is either deducted as part of the settlement or invoiced to the Provider, according to the configuration and agreements in place. Card data is not stored on MaiKupo's servers; payment data is handled by Stripe in accordance with its own terms and privacy policy.


Unless otherwise stated, amounts displayed to Customers are set by the Provider. Payment processing and settlements are subject to the terms of the relevant payment processor (Stripe). For more information, please consult Stripe Services Agreement and Stripe Privacy Policy.


MaiKupo is not a party to the contract between Customers and Providers, except in relation to the technological intermediation service and, where applicable, collection and settlement services agreed with Providers.

CANCELLATIONS, CHANGES, NO-SHOWS, AND REFUNDS

Each Provider may define its own cancellation policy based on advance notice (measured in hours) and applicable penalties. These policies are configured by the Provider within MaiKupo and are displayed to the Customer during the booking process. By completing a booking, the Customer accepts the Provider's cancellation policy for that session.


Responsibility for cancellations, changes, and no-shows lies with the Provider. Refunds, penalties, and rescheduling due to cancellations or no-shows are managed according to the applicable Provider policy and the information shown at the time of booking. MaiKupo provides the technical means to communicate and, where applicable, enforce such policies, but the decision on eligibility and amounts rests with the Provider, without prejudice to mandatory consumer law.


Providers are responsible for notifying Customers of any changes or cancellations initiated by the Provider. In case of Provider-initiated cancellations, Customers shall be entitled to a refund or alternative arrangement according to the policy communicated for the session and applicable law. Where payments were processed through Stripe, any refund will be issued via Stripe according to the Provider's policy and Stripe's rules.

ACCOUNTS AND REGISTRATION

To use certain features, Users may need to create an account, providing accurate and up-to-date information. Users are responsible for maintaining the confidentiality of their credentials and all activities under their account.


MaiKupo may suspend or terminate accounts that violate these Terms, applicable law, or third-party rights.

ACCESS AND BROWSING: DISCLAIMER OF WARRANTIES AND LIABILITY

MaiKupo does not guarantee the continuity, availability, or usefulness of the Website, its Contents, or Services. While MaiKupo will strive to ensure proper operation, it does not guarantee that access will be uninterrupted or error-free, nor that the content or software is free of errors or will not cause damage to the User's system.


Under no circumstances shall MaiKupo be liable for losses or damages arising from access, browsing, and use of the Website, including those caused by viruses or by inappropriate use of the Website. In particular, it is not liable for outages, interruptions, or defects in telecommunications.

LINK POLICY

The Website may provide Users with linking tools (links, banners, buttons), directories, and search engines that allow access to third-party websites. Their installation aims to facilitate the search for and access to information available on the Internet, and does not imply a suggestion, recommendation, or invitation to visit them.


MaiKupo does not guarantee the technical availability, accuracy, truthfulness, validity, or legality of third-party websites accessed through such links and assumes no responsibility for damages arising from their access or use.


The creation of a hyperlink to the Website does not imply any relationship between MaiKupo and the owner of the site on which it is created, nor MaiKupo's knowledge or acceptance of the contents or services offered there.

INTELLECTUAL AND INDUSTRIAL PROPERTY

MaiKupo, either by itself or as licensee, owns or lawfully uses the intellectual and industrial property rights to the Website and the elements contained therein (including, without limitation, images, audio, video, software, texts, trademarks or logos, color combinations, structure and design, and computer programs necessary for its operation, access, and use). These works are protected by Spanish and European Union law and international treaties.


Except as expressly authorized, reproduction, distribution, public communication (including making available), or any other exploitation of all or part of the contents of the Website for commercial purposes, in any medium and by any technical means, is prohibited without prior written authorization from MaiKupo.


Users may view elements of the Website and print, copy, or store them on a physical medium solely for their personal use. Users may not remove, alter, or manipulate any protection device or security system installed on the Website.

DATA PROTECTION

Processing of personal data collected through the Website is governed by our Privacy Policy, which the User should read carefully.

LEGAL ACTIONS, MEDIATION, APPLICABLE LAW AND JURISDICTION

MaiKupo reserves the right to initiate civil or criminal actions it deems appropriate in case of improper use of the Website, its Contents, or breach of these Terms.


Before initiating legal proceedings, the parties agree to make a good-faith attempt at mediation to resolve any dispute related to the interpretation or application of these Terms.


The relationship between the User and MaiKupo shall be governed by Spanish law. For any dispute, the parties shall submit to the courts and tribunals of Palma de Mallorca, Spain, without prejudice to any mandatory jurisdiction rules applicable to consumers.


Consumers may also use the European Union’s Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
